FTC NON-COMPETE CLAUSE FINAL RULE ISSUED... Yesterday, the Federal Trade Commission (FTC) officially published a final rule eliminating the use of Non-Compete Clauses, with narrow exceptions for existing non-compete provisions of “senior executives,” when selling a business, and also excludes the franchisee-franchisor relationship. The final rule will take effect on September 4, 2024. However, as legal challenges mount, the rule will likely be delayed. 

 

SBA FINALIZES “BAN THE BOX” RULE... On Friday, the Small Business Administration announced it would expand access to its capital programs for individuals with criminal histories. The change does away with antiquated restrictions on Americans who have completed their sentences for past crimes and takes effect May 30th, 2024.  

 

NEW REPORTS SHOW SMALL BUSINESS OWNERS ARE (MOSTLY) POSITIVE ABOUT  2024... There is a lot of good news (mixed with some challenges) in several reports and surveys of the nation’s small business owners. The just-released 2024 Bank of America Business Owners Report reveals some important positive trajectories. 


HAPPY NATIONAL GOLF DAY... The American Golf Industry Coalition is in Washington, D.C. for National Golf Day, bringing together golf enthusiasts, industry leaders, and policymakers in a unified effort to advocate for the future of the sport and industry. They will host a reception on the Hill featuring members of the Congressional Golf Caucus, and feature one of the most prestigious trophies in all of golf, the Solheim Cup, which will be played outside of Washington D.C. this September.

WHAT WE'RE WATCHING: 


Idaho state government has implemented a new policy this spring, requiring that no more than 20% of an agency's workforce be remote on any given day. This move will promote in-office collaboration and is part of a broader effort to balance remote work benefits with the demands of public service roles. 


New York is set to expand its New York Hiring for Emergency Placement program across nearly all state agencies, waiving certain civil service examination requirements to address a severe workforce shortage. This initiative will now help fill thousands of positions by streamlining the hiring process as the state anticipates a large number of retirements in the coming years.

The U.S. Department of Labor 

The U.S. Department of Labor issued a press release encouraging construction employers to join the 2024 National Safety Stand-Down to Prevent Falls. 


The U.S. Department of the Treasury 

The U.S. Department of the Treasury announced the United States has sanctioned the leader of the Russian-based ransomware group LockBit.

The U.S. Trade Representative  

The U.S. Trade Representative released a readout of the meeting of the United States-Iraq Trade and Investment Framework Agreement Council. 


The U.S. Trade Representative office announced Neil Beck will serve as Acting U.S. Trade Representative for WTO and Multilateral Affairs. 

 

The U.S. Small Business Administration 

The U.S. Small Business Administration announced that it will open disaster loan outreach centers in Jasper, Call and Woodville, TX to help residents and businesses that were affected by storms, flooding, hail and straight-line winds occurring April 8-26.
